Beginning January 1, 2021, there are new tiers of PC 290 registration. Registrants in Tier 1 or Tier 2 may be able to petition the court for removal from 290 registration after their birthday following July 1, 2021.
- Adult Tier 1: 10 year minimum registration period
- Adult Tier 2: 20 year minimum registration period
- Adult Tier 3: Lifetime registration
- Juvenile Tier 1: 5 year minimum registration period
- Juvenile Tier 2: 10 year minimum registration period
Your tier is based on your conviction(s). Your registration period begins when you are released from custody. Your registration period can be extended if you spent time in custody or were convicted for failing to register.
YOU MUST CONTINUE TO REGISTER
Removal from PC 290 registration is NOT automatic. It is very important that you keep your registration current and accurate. Continue to register regularly as you have in the past. To be removed from the PC 290 registry, you must file a petition. The Law Offices of the Public Defender can file this petition and represent you in court. The judge must rule in your favor to end your PC 290 registration.
If you have any questions about your tier, your registration period, or filing a petition for removal, we strongly recommend that you contact the Public Defender’s Post-Conviction Relief Unit or other legal office to advise and assist you.
You cannot be on parole, probation, or other supervision when you petition for removal. If you improperly file your petition, or file before you are eligible, it may cause the court to delay your petition for one to five years.
